A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to face human smuggling allegations, he was held in immigration custody.
In her decision, the judge noted that the authorities does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
The court challenge center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in Tennessee.
The judge, who was hearing his petition to removal in a federal court, determined that he must now adhere to the conditions of his bond from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
This ruling represents a notable development in a complicated legal case featuring claims of wrongful detention and disputed gang affiliations.
